  • Yo Crypto is a French MIC registered in the RCS Lyon under the number SIRET 87937489000017 with a share capital of 5,000 €, and whose registered office is located in represented by Mr. Dylan Desbos in his capacity as manager. The company Yo Crypto offers a buying guide, via its website yo-crypto.io, allowing to buy goods in crypto-currency. The Site is a site for customers to compare and purchase products. Yo Crypto provides the Site to offer and then, where appropriate, direct sale between the Merchant and the Customer. Yo Crypto is in no way the seller of the Products offered for sale and purchased through the Site. The General Terms and Conditions of Sale below apply to the services of the Site without restriction or reservation.

Article 1 - Definitions

Website shall designate the Internet site hosted under the domain names yo-crypto.io

Customer means any natural person who is not a merchant purchasing on the Site

Merchant shall designate professional vendors, companies independent of Yo Crypto, offering for sale on the Site, new or reconditioned Products at a fixed price

Yo Crypto SAS Yo Crypto: refers to SAS Yo Crypto, owner of the site, registered with the RCS of Villefranche-Tarare under the SIRET number 91858925000011  and whose registered office is located at 598 Boulevard Albert Camus 69400 Villefranche-sur-Saône.

Account means the connection account allowing the Customer to connect to the Site, giving access to his Customer area

Ordering means the request for Products made by the Customer

Delivery means the receipt of the Product by the Customer

Product shall designate the products offered for sale on the Site

Personal Data information relating to an identified or identifiable natural person, directly or indirectly.

Customer Terms and Conditions of Use Terms and Conditions of Use: refers to the general terms and conditions of use that apply to any Customer accessing the Site, also referred to as the "Customer Terms and Conditions".

General Terms and Conditions of Use Merchant Terms and Conditions of Use: means the general terms and conditions of use that apply to any Merchant using the Site, also referred to as the "Merchant TOU".

General Terms and Conditions of Sale Terms and Conditions of Sale: means the general terms and conditions of sale which are the subject of these Terms and Conditions of Sale and which apply to any Customer using the Site, also referred to as "GTC".

Article 2 - Purpose and scope

The purpose of these General Terms and Conditions of Sale (hereinafter the "GTCS") is to define the terms and conditions for making the Site available as well as the terms and conditions for distance selling of Products on the Site.

Thus the GTC apply to all sales of Products made through the Site, between the Customer and the Merchant. Yo Crypto cannot be considered as the seller of the Products purchased through the Site, and that only the Merchant whose identity is indicated on the Product sheet is the Customer's co-contractor for the sale of the Products.

They can be consulted on the Site and accessed by clicking on the acceptance of the payment of the order.

All Orders imply the Customer's unreserved acceptance of and full compliance with these GTC.

These GTC exclude the possibility for the Merchant to have his own General Terms and Conditions of Sale.

These General Terms and Conditions of Sale are supplemented by the Customer General Terms and Conditions of Use and the Merchant General Terms and Conditions of Use.

Provision of the site

Article 3.1 - Use of the Site by Clients

The Site can be used by any Customer.

The use of the Site by Customers is free of charge, with no obligation to purchase. To acquire the Products offered for sale through the Site, the Customer must refer to article 4.

Article 3.2 - Use of the Site by Merchants

The commercial relationship between Merchants and Yo Crypto is governed by the Merchant Terms and Conditions, which specifies the commitments to which they are bound for the purpose of selling Products on the Site.

If the Merchant does not respect the contractual commitments, Yo Crypto reserves the right to derefer the Merchant's Products on the Site and, if necessary, to terminate the contractual relationship with the Merchant.

Article 3.3 - Comparison and ranking of Products

The Site's service is free or subject to a fee for Merchants, depending on the offer chosen. These pricing conditions have an impact on the ranking of Merchants' offers.

The Products offered by the Merchants on the Site are classified by Product category.

The Site provides Customers with various criteria for classifying Products, which the Customer selects according to his preferences:

Labels: Yo Crypto uses a library of official and unofficial labels created by Yo Crypto. The Products are then proposed according to a weighting algorithm allowing them to be positioned according to the points assigned to each label.

Article 3.4 - Product sheet

Each Product offered for sale by the Merchant is described on a Product sheet on the Site, containing the following information:

  • The precise name of the Product
  • A detailed description of the Product
  • Product brand
  • The EAN (if)
  • Its capacity as a manufacturer, importer in the European Union or reseller of the Product
  • The existence of labels or quality signs concerning the Product
  • The stock of Products available according to options
  • The visual quality of the product
  • Indicate any options available on the Product (colours, sizes, etc.)
  • Indicate the selling price of the Product on the Site
  • Any commercial guarantees applicable to the Product
  • The existence or not of a right of withdrawal on the Product in accordance with the provisions of the Consumer Code.

Article 3.5 - Yo Crypto messaging

The Customer may contact Yo Crypto and the Merchant via the messaging system accessible on his Account, for any enquiry regarding his Order.

Article 4 - Ordering

Article 4.1 - Customer identification

The Customer must have the legal capacity to contract.

To place an Order, the Customer must identify himself and create an Account with his e-mail address and a password (see Customer Terms and Conditions for help in creating an Account).

Account creation is prohibited for minors under the age of 16 and requires a compatible date of birth.

Article 4.2 - Registration and validation of the Order

Products may be ordered via the Site or directly from the Merchant's online or physical shop.

If the Order is placed outside the Site, the Customer is redirected by clicking on the Product to the Merchant's online site or to the Merchant's shop. The Order will then be processed directly by the Merchant in accordance with its General Terms and Conditions of Sale.

In this case, the present GTC of the Yo Crypto Site will no longer be applicable to the Customer.

If the Order is placed through the Site, the terms and conditions are as follows:

  • The Customer adds the Product(s) he/she wishes to purchase to his/her shopping cart. The Delivery Costs will be added to the price of the Products
  • The Customer checks his Order and the total price indicated
  • The Customer confirms his/her Order by clicking on "order" and reads the GTC by clicking on the link, and accepts them by ticking the words "acceptance of the GTC".
  • The Customer shall indicate the billing and delivery address for the Order (in accordance with Article 6.2)
  • The Customer will have access to a summary of his Order before proceeding to payment
  • The Customer pays for the Order and receives an email confirming that the Order has been processed
  • Yo Crypto notifies the Merchant by email of the Product Order via the API on its information system or via its Merchant space on the Site
  • The Merchant shall be bound by the Customer's Order upon receipt of notice of the Customer's Order.
  • The Merchant shall send the invoice to the Customer upon delivery of the Product ordered in the package.

For any question related to the Order, the Customer can contact the Merchant through his Yo Crypto email.

Article 5 - Tariff conditions

Article 5.1 - Price of the Products

The price of the Products on sale on the Site is freely set by the Merchant and is not negotiable by the Customer.

The price is indicated in euros including all taxes and does not include delivery costs.

The prices of the Products are those in force at the time the Order is registered.

Article 5.2 - Terms of payment

If the Order is placed in the Merchant's online shop, i.e. outside the Site, then the payment terms are handled by the Merchant in accordance with its General Terms and Conditions of Sale.

In this case, the T&Cs of the Yo Crypto Site will no longer be applicable to the Customer.

If the Order is placed via the Website, the Customer must pay for the Products at the time of the Order using one of the following options:

  • By credit card (Visa, Mastercard) with the possibility of registering the card
  • By gift card
  • By Yo Crypto vouchers: It is possible to use the vouchers issued by Yo Crypto for the payment of all or part of the Order (the terms of acquisition and use are available on the site under the "Loyalty Programme" tab).
  • Yo Crypto reserves the right not to offer one or more of the above payment methods, for any legitimate reason and in particular in the event that :
    • One of the Client's previous Orders has not been paid in full by the due date or a dispute concerning the payment of one of the previous Orders is being processed
    • There are serious and consistent indications that the Commission is suspected of fraud.

  • Article 6 - Delivery of the Order by the Merchant

Article 6.1 - Delivery costs

Delivery costs are to be borne by the Customer who has placed and validated an Order.

The amount of the fees shall be indicated to the Customer before the final validation of the Order.

Delivery charges may vary depending on the amount or number of Products purchased by the Customer. In such cases, this information shall be clearly indicated to the Customer on the Order page and on the Order summary.

Article 6.2 - Delivery method

The conditions, costs and delivery times differ depending on the delivery method chosen.

At the time of placing the Order, the Customer will be informed of the delivery method(s) available as well as the delivery time(s) and price(s) applicable to each Product.

Yo Crypto can offer the Customer the following delivery methods:

  • Delivery to the address chosen by the Customer
  • Withdrawal from the Merchant's shop
  • Delivery to a collection point
  • After confirmation of the Order, Yo Crypto shall communicate the Order to the Merchant including the delivery method chosen by the Customer.
    The Products will be delivered by the Merchant, or any person appointed by the Merchant, on behalf of the Merchant, directly to the Customer, according to the Customer's choice made when placing the Order on the Website.
     The Merchant will have a document of receipt signed by the Customer via his carrier.
     Delivery consists of the transfer to the Customer of physical possession of the Product(s).
     The Customer is solely responsible for any failure to deliver due to a lack of information at the time of the Order.
     In cases where the delivery of the Products calls for reservations, the Customer may notify the carrier at the time of delivery.
     In the event that a Product is returned to the Merchant by the carrier (in particular in the event of an address error or failure to collect the parcel from the address indicated to the Customer), the Customer shall be refunded the amount of the Order and the outward carriage costs, with the return carriage costs remaining at the Customer's expense, provided that the error in delivery is exclusively attributable to the Customer, unless the Customer has expressly agreed to be delivered to a new address or on a new date.
     In any event, the Merchant undertakes to contact the Customer via the dedicated messaging space on the Site, in order to propose a satisfactory solution to the Customer.

     Article 6.3 - Delivery date
     
    The Merchant undertakes to dispatch the Products or to make the Products available for collection by the Customer within a maximum period of one working day from the receipt by the Merchant of the Order transmitted by Yo Crypto.

     In the event that the delivery deadline is exceeded, in accordance with Article L216-2 of the French Consumer Code, the Customer shall inform the Merchant via the Yo Crypto messaging system and give the Merchant formal notice to deliver within a reasonable additional period in order to fulfil the Order.
     If at the end of this additional period the Delivery has still not been made, and if the non-delivery is not attributable to the Customer, the Customer may cancel the Order in writing via the Yo Crypto messaging system.
     The Merchant will then refund the price paid by the Customer.

     Article 7 - Right of withdrawal

In accordance with article L221-18 of the French Consumer Code, the Customer has a right of withdrawal of fourteen (14) days to exercise his right of withdrawal, without having to give reasons for his decision, nor to pay any penalty, for the purpose of exchange or reimbursement, provided that the Products are returned in their original packaging and in perfect condition within fifteen (15) days following the notification to the Merchant of the Customer's decision to withdraw.

Damaged, soiled or incomplete Products will not be taken back.

The Customer shall exercise his right of withdrawal directly to the Merchant, by informing him without ambiguity of his wish to withdraw, by filling in the form available on his Account.

This entry by the Customer will automatically generate an email notification to the Merchant.

The Merchant undertakes to acknowledge receipt of the Customer's request using the Yo Crypto messaging system provided on the Site, within a maximum of 24 working hours, except in the case of shop closure. Consequently, the Customer may consult the associated Product sheets indicating the periods of closure so that the Customer has all the necessary information, in particular on the delivery times of the Products ordered.

In the event that the Customer exercises the right of withdrawal, this acknowledgement of receipt must indicate to the Customer the procedures for returning the Products and any costs applicable to this return.

In the event that the solution proposed by the Merchant following the exercise of its rights by the Customer is not fully satisfactory to the Customer, Yo Crypto may, if it deems it necessary, contact the Customer in order to propose a satisfactory solution.

Yo Crypto and the Merchant shall endeavour to work together in good faith to provide a satisfactory solution to the Customer.

Article 8 - Liability

 

Article 8.1- General

Yo Crypto does not own the Products, which remain the property of the Merchant.

Furthermore, the Merchant remains the sole custodian of the Products until the Products are delivered to the Customer.

Yo Crypto is only an intermediary between the Customer and the Merchant.

Article 8.2 - Merchant's liability

The Merchant assumes full responsibility for the Products it offers for sale on the Site, and will deal solely with claims relating to the Products.

The Merchant is solely responsible for compliance with the regulations applicable to the Products marketed on the Site, for the quality of the Products (safety, BBD and DDM in particular) and for compliance with the intellectual property rights of third parties on the Products.

The Merchant is solely responsible for the display or claim of a label or sign of quality on a Product.

The Merchant undertakes to immediately remove from the Site any batch of Products that are subject to a recall or withdrawal procedure.

In the event of a complaint concerning the Products delivered, the Customer must contact the Merchant via the Yo Crypto messaging system provided.

The Merchant shall settle the dispute with the Customer himself.

The Customer and the Merchant shall use their best efforts to reach an amicable resolution of the dispute.

Article 8.3 - Responsibility of Yo Crypto

Yo Crypto is only bound by an obligation of means in the execution of the services offered on the Site.

Yo Crypto shall not be held liable for the execution of a sale concluded between the Merchant and the Customer on the Site, in particular with regard to the conformity of the Product, the conformity of the offer to sell, the conditions of execution of the after-sales service, the ownership of intellectual property rights relating to the Products.

Yo Crypto shall only be liable to the Customer for acts directly attributable to it in its capacity as intermediary and which have caused direct damage to the Customer.

Yo Crypto undertakes to make its best efforts to secure access to and use of the Site and is free to choose the most appropriate form and technical means to make available to users all the features of the Site.

The Site will be accessible 24 hours a day, 7 days a week.

By way of derogation, the Site may be temporarily unavailable during corrective or evolutionary maintenance operations necessary for the proper functioning of the Site and in the event of the occurrence of an event beyond the control of Yo Crypto.

In the event of a technical failure affecting the functioning of the Site, Yo Crypto undertakes to make its best efforts to restore the functioning of the Site as soon as possible.

Yo Crypto shall not be held responsible for external intrusions, the presence of computer viruses in the computer system of the Customer using the Site, the possible consequences of a total or partial alteration of the functioning of the Site due to misuse of the Site by the Customer, the non-functioning or slowness of the Customer's telecommunications network.

Article 9 - Guarantees

 

Article 9.1 - Legal guarantees

All Products sold through the Site benefit from :

The legal guarantee of conformity, for defective, damaged or damaged Products or not corresponding to the Order;

The legal guarantee against hidden defects resulting from a material, design or manufacturing defect affecting the Products delivered and making them unfit for use, under the conditions and according to the methods referred to in the box below and defined in the appendix to these GTC (Appendix 1).

It is recalled that in the context of the legal guarantee of conformity, the Customer benefits from a period of two years from the delivery of the goods to act; may choose between repairing or replacing the ordered Product, subject to the cost conditions provided for in Article L.217-9 of the Consumer Code; is exempt from proving the existence of the Product's lack of conformity during the six months following delivery of the Product. This period is extended to 24 months as of 18 March 2016, except for second-hand goods.

The legal guarantee of conformity applies independently of the commercial guarantee that may cover the Product. The Customer may decide to implement the warranty against hidden defects of the Product in accordance with Article 1641 of the Civil Code; in this case, he/she may choose between the resolution of the sale or a reduction of the sale price in accordance with 1644 of the Civil Code.

These guarantees are without prejudice to the right of withdrawal provided for in Article 7.

The Merchant guarantees the conformity of the Products within the framework of these two legal guarantees.

Article 9.2 - Commercial guarantees

Certain Products for sale on the Site may benefit from a commercial guarantee granted by the Merchant.

The existence of this contractual guarantee is indicated in the Product sheet on the Site.

Article 9.3 - Implementation of guarantees

In the event of a legal or contractual guarantee request, the Customer must contact the Merchant via the Yo Crypto messaging system.

The Merchant undertakes to acknowledge receipt of the Customer's request using the Yo Crypto messaging system provided on the Site, within a maximum of 24 working hours, except in the case of shop closure. Consequently, the Customer may consult the associated Product sheets indicating the periods of closure so that the Customer has all the necessary information, in particular on the delivery times of the Products ordered.

The Merchant undertakes to provide a solution to the Customer within a maximum of 48 working hours (except during closed periods) from the sending of the aforementioned acknowledgement of receipt, indicating to the Customer the modalities for returning the Product or the possibility of opting for a refund or replacement of the Product.

In the event that the solution proposed by the Merchant following the exercise of his rights by the Customer is not fully satisfactory to the Customer, the latter may make a complaint concerning a Product directly on the Site.

Yo Crypto shall inform the Merchant and they shall endeavour to work together in good faith to provide a satisfactory solution to the Customer.

Article 10 - Force majeure

 

Yo Crypto shall not be held responsible for the non-performance or delay in the performance of any of its obligations described in these GTCs resulting from a case of force majeure, as defined in Article 1218 of the Civil Code.

All facts or circumstances outside Yo Crypto's control, unforeseeable, unavoidable, independent of Yo Crypto's will, and which cannot be prevented by Yo Crypto, despite all reasonable efforts, will be considered as force majeure.

In addition to the cases retained by the legislation in force and French jurisprudence, the following events are considered to be cases of force majeure, and this without being exhaustive

  • Blockages in communication networks and systems
  • Full or partial strikes, lockouts, boycotts or similar events
  • Hacker attacks.

Article 11 - Personal data

 

The Customer is informed that all data collected in the context of the operation of the Site are processed by Yo Crypto.

The Customer is invited to refer to the "Privacy Policy" tab of the Site for full information on this point.

Article 12 - Intellectual property

 

The Customer undertakes to respect the intellectual property rights of Yo Crypto and in particular, all the elements of the Site including the content of the Site, the brands, drawings, photographs, images, texts, the general structure and tree structure, the graphic charters, the databases, the logos, the domain names including in particular the name Yo Crypto, all the documents or files, any other distinctive sign present on the Site, including the underlying technology, belonging to Yo Crypto which are protected by French and international laws relating to intellectual property.

No intellectual property rights shall be transferred to the Customer.

Any total or partial reproduction of Yo Crypto's intellectual property rights is strictly forbidden and may constitute an infringement.

The Client may refer to the Yo Crypto Site for advertising and/or promotional purposes with Yo Crypto's prior and express consent.

The Customer shall be liable for any infringement of intellectual property rights.

Article 14 - Modification of the General Terms of Sale

 

Yo Crypto reserves the right to modify, update, rectify and this freely and at any time the present GTC in order to respect the legislative, regulatory and / or jurisprudential developments.

Any changes will be directly applicable to the Customer.

In this case, the new GTC will only apply to sales made after the modification and/or adaptation.

Article 13 - Clause deemed unwritten

 

If one or more clauses of these GTC are declared invalid, they shall be deemed unwritten without invalidating the whole of these GTC.

Article 14 - Applicable law

 

These GTC are subject to the application of French law.

In the event that these GTC are translated into a foreign language, only the French text shall be deemed authentic in the event of a dispute over the acceptance of a term or provision of these GTC.

Article 15 - Jurisdiction and settlement of disputes

 

Any disputes that may arise between Yo Crypto and the Customer shall be subject to an attempt at amicable resolution, before any legal action is taken.

In the event of a dispute between the Customer and Yo Crypto relating to the GTC, the Customer is informed that, in accordance with the provisions of the Consumer Code, Yo Crypto has appointed a mediator whom he may contact at the following address

The mediator will be the FEVAD (Fédération du e-commerce et de la vente à distance) e-commerce mediator by accessing the online form at the following address

At the end of the mediation, the mediator will propose a solution.

The parties remain free to accept or refuse recourse to mediation and, in the event of recourse to mediation, to accept or refuse the solution proposed by the mediator.

In the absence of an amicable agreement, any dispute shall be brought before the courts of the jurisdiction of Yo Crypto's registered office, including in the event of multiple defendants, this being expressly accepted by the Customer.

APPENDIX 1 - Provisions relating to legal guarantees

Article L217-4 of the Consumer Code

"The seller shall deliver goods in conformity with the contract and shall be liable for any lack of conformity existing at the time of delivery.

He shall also be liable for any lack of conformity resulting from the packaging, the assembly instructions or the installation when the latter was made his responsibility by the contract or was carried out under his responsibility.

Article L.217-5 of the Consumer Code

"The property is in conformity with the contract:

1° Whether it is fit for the purpose ordinarily expected of similar goods and, if so :

- if it corresponds to the description given by the seller and has the qualities presented to the buyer in the form of a sample or model;

- it has the qualities that a purchaser may legitimately expect, having regard to the public statements made by the seller, the producer or his representative, in particular in advertising or on labelling;

2° Or if it has the characteristics defined by mutual agreement between the parties or is fit for any special purpose sought by the buyer, brought to the attention of the seller and accepted by the latter.

Article L.217-12 of the Consumer Code

"The action resulting from the lack of conformity shall be barred after two years from the delivery of the goods.

Article L.217-16 of the Consumer Code

"Where the buyer asks the seller, during the course of the commercial guarantee granted to him at the time of the acquisition or repair of a movable good, for a repair covered by the guarantee, any period of immobilisation of at least seven days shall be added to the duration of the guarantee that remained to run.

This period shall run from the date of the buyer's request for action or from the time the goods in question are made available for repair, if this is after the request for action.

Article 1641 of the Civil Code

"The seller is bound by the guarantee for hidden defects in the thing sold which make it unfit for the use for which it was intended, or which so diminish this use that the buyer would not have acquired it, or would only have given a lesser price for it, if he had known about them.

Article 1648 paragraph 1 of the Civil Code

"The action resulting from redhibitory defects must be brought by the purchaser within two years of the discovery of the defect.
